澳大利亚联邦法院三位法官合审的此案,事关退休警员 Stephen Cooper 架设的 MP3s4free.net 网站(现已关闭)上张贴 MP3 音乐文件的网站链接,究竟合不合法?Cooper 网站上列出的 MP3 链接,绝大多数都导向存在别处服务器上的 MP3 音乐文件,Cooper 本人似乎未在自己的网站上提供任何受著作权保护的音乐。
结果,上诉法院支持今年夏季法官的判决,也认定这种链接做法触犯澳大利亚的著作权法,因此判定 2004 年提出告诉的环球音乐澳大利亚分公司及其它几家大型唱片公司胜诉。
